1. Anwendungsbereich:
Unsere nachstehenden Vertragsbestimmungen gelten für die Lieferung und den Verkauf unserer Waren gegenüber privaten Verbrauchern und sonstigen Bestellern. Gegenüber Bestellern, die keine privaten Verbraucher sind, gelten die Vertragsbestimmungen allerdings nur mit der Maßgabe, dass das in der Widerrufsbelehrung näher bezeichnete Widerrufsrecht keine Anwendung findet. Hiervon abweichende allgemeine Geschäftsbedingungen sind nur gültig, wenn diese mit uns ausdrücklich vereinbart wurden.

2. Vertragspartner:
Vertragspartner im Rahmen dieser Allgemeinen Geschäftsbedingungen (AGB) sind Bendix Bauer, Ifflandstraße 1, 10179 Berlin als Verkäufer und der Käufer. Das Angebot richtet sich ausschließlich an nach ihrem lokalen Recht geschäftsfähige Personen.

3. Vertragsschluss:
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern einen unverbindlichen Online-Katalog dar. Irrtümer vorbehalten. Irrtümer und Änderungen bleiben vorbehalten. Durch Anklicken des Bestellen-Buttons (“Make Purchase”) im letzten Schritt des Bestellprozesses geben Sie ein verbindliches Angebot zum Kauf der im Warenkorb enthaltenen Waren ab. Der Kaufvertrag jedoch erst kommt durch unsere ausdrückliche Annahmeerklärung oder Lieferung der bestellten Ware zustande. Als Bestätigung des Eingangs Ihres Angebots senden wir Ihnen Ihre Bestelldaten umgehend per Email zu. Unsere AGB können Sie jederzeit einsehen, speichern und ausdrucken.

4. Preise und Zahlungsbedingungen:
Die auf der Produktseite aufgeführten Preise sind inklusive Mehrwertsteuer, aber exklusive Versandkosten. Lieferungen in Nicht-EU-Länder werden ohne die gesetzliche Mehrwertsteuer von 19% berechnet. Der Kaufpreis wird sofort mit der Annahmeerklärung fällig.
Die Bezahlung des Kaufpreises sowie der Versandkosten kann der Besteller entweder per PayPal oder Vorkasse per Banküberweisung vornehmen.

Um mit Paypal bezahlen zu können, benötigt der Besteller ein Paypal Konto. Informationen zu Paypal finden Sie auf www.paypal.com.

Um per Vorkasse zu zahlen, ist der in der Bestellbestätigung ausgewiesene Betrag auf das folgende Konto unter Angabe der Bestellnummer zu überweisen. Nach Zahlungseingang erfolgt der Versand der Ware.

5. Lieferungen in Nicht-EU-Länder:
Lieferungen in Nicht-EU-Länder werden ohne die gesetzliche Umsatzsteuer berechnet.
Bei Lieferungen in Nicht-EU-Länder fallen zusätzliche Zölle und Gebühren an, die vom Besteller zu bezahlen sind.

6. Versandkosten:
Zusätzlich zu den angegebenen Preisen berechnen wir für die Lieferung innerhalb Deutschlands pauschal 8,50 EUR pro Bestellung.

Die Lieferung ins Ausland berechnen wir pauschal pro Bestellung wie folgt:

7. Lieferung:
Lieferungen erfolgen mit UPS. Sollte die Zustellung der Ware trotz zweimaligem Auslieferversuchs scheitern, behalten wir uns den Rücktritt vom Vertrag vor. Gegebenenfalls erfolgte Gegenleistungen werden Ihnen unverzüglich erstattet. Wenn das bestellte Produkt nicht verfügbar ist, weil wir mit diesem Produkt von unseren Lieferanten ohne eigenes Verschulden nicht beliefert werden, behalten wir uns den Rücktritt vom Vertrag vor. In diesem Fall werden wir Sie unverzüglich informieren und Ihnen gegebenenfalls die Lieferung eines vergleichbaren Produktes vorschlagen. Wenn kein vergleichbares Produkt verfügbar ist oder Sie keine Lieferung eines vergleichbaren Produktes wünschen, werden wir Ihnen gegebenenfalls erfolgte Gegenleistungen unverzüglich erstatten. Die Lieferung erfolgt nach Eingang des Kaufpreises bei Bendix Bauer.

8. Eigentumsvorbehalt:
Die gelieferten Waren bleiben bis zur vollständigen Bezahlung Eigentum von Bendix Bauer.

9. Datenspeicherung und Datenschutz:
Wir behandeln alle von Ihnen erhobenen persönlichen Daten streng vertraulich. Die für die Vertragsdurchführung notwendigen Daten werden elektronisch gespeichert und verarbeitet, soweit dies für die Abwicklung und Durchführung des Vertrags notwendig ist. Eine Datenerhebung, - übermittlung und/oder sonstige Verarbeitung personenbezogener Kundendaten zu anderen Zwecken wird von uns nicht vorgenommen.

10. Haftung:
Unsere Haftung auf Schadenersatz aus vertraglichen, vertragsähnlichen, deliktischen oder sonstigen Rechtsgründen wird ausgeschlossen; dies gilt nicht, wenn es um die Verletzung des Lebens, des Körpers oder der Gesundheit geht oder die Verletzung auf einem vorsätzlichen oder grob fahrlässigen Verhalten von Bendix Bauer oder ihrer Erfüllungsgehilfen beruht oder wenn es sich um die Verletzung einer für die Erreichung des Vertragszwecks wesentlichen Verpflichtung handelt. Unberührt bleiben ferner sonstige gesetzlich zwingende Haftungsansprüche, wie das Produkthaftungsgesetz.

11. Gerichtsstand und sonstige Bestimmungen:
Als Gerichtsstand wird unser Sitz vereinbart, wenn Sie Kaufmann sind oder keinen allgemeinen Gerichtsstand in der Bundesrepublik Deutschland haben. Sollten einzelne Bestimmungen unwirksam sein, so führt dies nicht zur Unwirksamkeit des gesamten Vertrags sowie der übrigen vertraglichen Bestimmungen. Die unwirksame Bestimmung wird durch die entsprechenden gesetzlichen Vorgaben ersetzt.

12. Anwendbares Recht:
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.

WIDERRUFSBELEHRUNG:

Widerrufsrecht:
Sie können Ihre Vertragserklärung innerhalb von zwei Wochen ohne Angabe von Gründen in Textform (z.B. Brief, E-Mail) oder durch Rücksendung der Sache widerrufen. Die Frist beginnt frühestens mit Erhalt dieser Belehrung. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Ware. Im Falle eines schriftlichen Widerrufs ist der Kunde verpflichtet, bereits erhaltene Waren unverzüglich, spätestens innerhalb einer Frist von 7 Tagen zurückzusenden. Versandschäden sind sofort, spätestens jedoch einen Tag nach erhalt der Ware, per Telefon oder schriftlich an Bendix Bauer zu richten. Der Widerruf, Rücksendungen oder Versandschäden sind zu richten an:

Das Widerrufsrecht besteht nicht bei Waren, die nach Kundenspezifikationen angefertigt werden oder eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind oder die aufgrund ihrer Beschaffenheit nicht für eine Rücksendung geeignet sind, sowie bei Auslandsbestellungen, für die das deutsche Fernabsatzgesetz nicht gilt. Daneben besteht das Widerrufsrecht nicht bei der Lieferungen von Sonderangeboten.

Widerrufsfolgen:
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Dies gilt nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung – wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre – zurückzuführen ist. Im Übrigen können Sie die Wertersatzpflicht vermeiden, indem Sie die Sache und deren Verpackung, nicht wie ein Eigentümer in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt.
Paketversandfähige Sachen sind zurückzusenden. Bei einer Rücksendung aus einer Warenlieferung, deren Bestellwert insgesamt bis zu 40 Euro beträgt, haben Sie die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht. Anderenfalls ist die Rücksendung für den Kunden kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt.
Bitte beachten Sie, dass ein portofreier Versand der Ware an Sie das Rückporto bei einer eventuellen Rückgabe- oder Umtauschlieferung nicht beinhaltet!

4. Prices and Payment:
Mentioned on the product pages prices include VAT and all other price components, but no shipping costs. Deliveries to Non-EU-Countris will be charged without the VAT.

Payment is possible at your choice by PayPal or by advance payment via bank transfer.

For PayPal payment you need to have a PayPal account. Further information can be found at www.paypal.com.

For advance payment via bank transfer, please transfer the amount with your purchase number to the following account. After you've pressed the "make purchase" button, you will recieve a confirmation email from us including our bank details. Any items to be shipped will be processed as soon as payment is received.

5. Deliveries to Non-EU-Countries:
Deliveries to Non-EU-Countris will be charged without the VAT.
For deliveries to non-EU countries additional duties and fees might be applicable that are payable by you.

Shipping costs charged by Bendix Bauer are supplemental to the prices of goods.

7. Deliveries:
Any items to be shipped will be processed as soon as possible after payment is received. Products will be shipped directly from Germany by UPS. Packages must be signed for. International orders may take longer.
Please note: If a package is not claimed by the purchaser and subsequently returned to Germany, Bendix Bauer will not send a replacement. Bendix Bauer is not responsible for any actions taken by customs agencies which affect your package in transit, nor does the company exercise any control over such matters. The purchaser is responsible for any customs charges that may be applied to the package. Such charges are determined by the customs agencies of each country and Bendix Bauer has no way of ascertaining how high these may be.

Should the delivery of the goods, despite two attempts to deliver, fail, we reserve the right to withdraw from the contract. Where appropirate, consideration will be promplty refunded.
Should the ordered product not be available, because we are not supplied with this product from our suppliers without fault, we reserve the right to withdraw from the contract. In this case we weill notify you and offer you where appropriate the delivery of a comparable product. If no comparable product is available or you do not wish to supply a comparable product, we will prompltly refund consideration.

8. Property:
The goods remain the property of Bendix Bauer until full payment.

9. Data storage and Security:
Personal information is gathered by bendixbauer.de/shop during the ordering process at the checkout. At this point, your name, address and e-mail address will be collected.
The security of the information regarding your order is very important to us. Please be assured that all sensitive information will be handled with discretion.

Bendix Bauer’s Privacy Policy applies to the use of this site and its terms are made a part of these Terms of Use by this reference. Additionally, by using the site, you have acknowledged and agreed that Internet transmissions are never completely private or secure. You have understood that any message or information you send to the website may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

The information we gather falls into two categories:

Liability: Our liability for damages arising from contractual, contractual, tortious or other legal grounds are excluded, except when it comes to the loss of life, limb or health or injury on an intentional or grossly negligent conduct of Bendix Bauer or if it is a violation of one obligation essential for the purpose of the contract. 11. Jurisdiction and other provisions:
It is agreed that the places of jurisdiction shall be in our headquarters in Berlin in the Federal Republic of Germany if you are a private individual, a businessman, or have no general jurisdiction in the Federal Republic of Germany. If individual provisions are invalid, this does not invalidate the entire contract and other contractual provisions. The invalid provision will be replaced by government regulations of the Federal Republic of Germany.

12. Applicable Law:
German Law, with the exeption of United Nations Convention on Contracts for the International Sale of Goods, is applicable.

CANCELLATION

Cancellation of contract:
You may cancel your contract within two weeks without explanation or reason by giving notice in writing (eg letter, e-mail) or by returning the goods. The deadline begins with receipt of this instruction. The customer hereby agrees that the revocation period is sufficient to send the withdrawal or the merchandise. In the case of a written cancellation the customer is obliged to return the goods already received without delay, within a period of maximum 7 (seven) days. Notice of damage to the goods that have occurred during shipping shall by given by phone, or in writing to Bendix Bauer immediately no later than one day after receiving the goods, by phone or in writing. Returns or shipping damage must be addressed to:

In the case of effective return, the goods and services taken by either party are to be returned and if applicable, goods and services used (e.g. compensation for use) are to be compensated. A value compensation claim can be demanded with the deterioration of goods. This does not apply if the deterioration of the goods is exclusively attributed to testing, as it would be possible for buyers to do in shops. Otherwise the buyer can avoid the obligation for value replacement for using the goods according to the terms and conditions by not using the goods as his/her own property and omitting anything that impairs the value of the goods. The obligation to refund payments must be fulfilled within 30 days. The time limit begins for the buyer when the goods or return requisition are shipped; the time limit begins for the seller at the receipt of sent goods or the return requisition.
